Booth Pass

Terms of Service

Booth Pass · The Booth MKE, LLC · Effective September 4, 2026 · Updated October 9, 2026 (photo sharing permission)

These terms cover your use of Booth Pass, the guest account offered by The Booth MKE, LLC ("The Booth", "we"). By creating a pass or using the app you agree to them. Our Privacy Policy explains how we handle your information and is part of these terms.

What Booth Pass is

Booth Pass is a free account that keeps the photos you take at a Booth, lets a Booth recognise you when you check in, and lets you take part in group games and contests. It is offered as-is and we may change, pause, or retire features over time.

Your account

Your photos

You own the photos of you. By taking a photo at a Booth while signed in, or claiming one to your pass, you give us permission to store it, show it to you, deliver it where you ask, and include it in the gallery of the event where it was taken. If the event host booked the Booth, the host may also receive the event's gallery. We will not use a photo of your face in our own advertising without asking you first.

Letting a venue or The Booth share a photo. In My Photos you can switch on, for one photo at a time, either or both of: (1) the venue named on the screen and The Booth may post that photo on their own social pages and tag you if you give your handle; (2) they may also use it to promote their businesses on the booth screen, their websites and social media. Both start switched off, are only for people 18 and older, and confirm that everyone in the photo is 18 or older and OK with it. You get your photos, prints and rewards either way. Neither covers paid ads, which need your separate OK. We use the photo without payment to you. You can switch sharing off at any time in My Photos or Settings, or by emailing ben@theboothmke.com; we then stop new use, remove our posts and booth-screen use, and ask the venue to remove its posts, within 3 business days. Taking a photo without switching this on is never permission.

Only take and keep photos of people who are okay with being photographed. Don't upload or claim content that isn't yours or that is unlawful, hateful, or harassing. We can remove content that breaks these rules.

Booth Play and connect cards

Group games put you in photos with other guests. Everyone in a Booth Play photo can keep it in their pass, so only join if you're fine with that. Connect cards are for people 18 and older: by giving a card you confirm you are 18 or older. Only give your card to people you want to have it, and don't use links you receive to harass, spam, or contact someone who has blocked you. We can remove cards, block accounts, and close passes after a report.

Contests and votes

Contests are run by The Booth or by the venue or sponsor hosting a Booth. Picking a contest backdrop casts your vote. Contest rules, prizes, and eligibility are set by whoever is running that contest and may be posted at the Booth. Vote totals are shared with sponsors and venues; individual votes are not.

Acceptable use

Don't interfere with a Booth, the app, or other guests. Don't try to access accounts or data that aren't yours, scrape the service, or use it for anything unlawful.

Our liability

Booth Pass is provided "as is" without warranties of any kind. To the extent the law allows, The Booth is not liable for indirect or consequential damages arising from your use of the service, and our total liability to you for any claim related to Booth Pass is limited to $100. Nothing here limits liability that cannot be limited by law.

Changes and termination

We may update these terms; the date at the top will change and significant changes will be announced in the app. We may suspend or close accounts that break these terms. You can stop using Booth Pass and delete your account whenever you like.

Law

These terms are governed by the laws of the State of Wisconsin, USA.
